If we take on your case we will do so without any cost to you and if the claim is successful we will make no deduction from the compensation that you receive.

We have dealt with cases worth only a few hundred pounds through to cases worth more than a million pounds. All claims are dealt with by the partner in charge of litigation, who is a member of the Law Society’s Personal Injury Panel.

What is a personal injury claim?

A “personal injury claim” is shorthand for a claim for compensation for injuries or illness arising from the negligence or breach of statutory duty by a third party. If you have suffered an injury because of somebody else’s fault you may be entitled to substantial compensation. At Livingstons we can advise you about any of the following types of claim:

  • Road traffic accidents
  • Accidents at work
  • Repetitive strain injuries
  • Medical negligence
  • Industrial diseases (e.g. asbestosis)

We have experience of dealing with all these types of cases.

How can I pay the legal costs?

Legal Aid is no longer available for personal injury claims (other than medical negligence claims) except in a few special circumstances. Legally aided medical negligence work is now dealt with by a relatively small number of specialist firms. We do not undertake legally aided medical negligence work but can refer you to a firm that specialises in this field.

You can pay us privately to pursue your claim and we might ask you to do this if we think your claim is unlikely to succeed but you nevertheless wish to pursue it.

However, if you are privately funded you will be at risk of paying the other side’s costs as well as our own.

For this reason private funding is not usually a realistic possibility.

You may have legal insurance which will cover the cost of your claim. In that case, we would approach your legal insurers to ask them to nominate us to act on your behalf under the terms of your insurance policy.

The most common way in which personal injury claims are now funded is under a no win, no fee agreement (otherwise known as a Conditional Fee Agreement).

No win, no fee

At Livingstons we are able to offer a no win, no fee agreement in any case which we consider to have a good chance of success. When we take a case under a no win, no fee agreement we will work for nothing unless your claim is successful, in which case your legal costs are almost certain to be met by the other side. In addition, we will fund any disbursements, such as the cost of a medical report and Court fees. We will also pay an insurance premium to insure you against the risk of having to pay the other side’s costs. All of this means that we do not ask you for any money at any stage. If we are successful in your claim we normally charge a success fee but this is payable by the other side. We make no deductions from the damages that you receive.
