Advice and Assistance for Employers

We can assist by providing you with telephone, email or face to face advice on employment and industrial relations matters should any disputes or problems arise within your business. We can help with the whole range of employment issues, including disciplinary and grievance matters, redundancies and restructuring, compromise agreements and TUPE transfers, as well as providing ongoing advice in areas such as avoiding discrimination in the workplace and compliance with ever-changing legislation.

We can also draft, review or update your employment procedures, Staff Handbooks and Contracts of Employment to make sure that they keep up with changes to the law. Practically speaking, this usually involves an initial face to face meeting to identify the particular needs of your business. This would be followed by a review of all of your employment documents. We would make suggestions for amendment and, if necessary, draft policies and procedures for inclusion in your Staff Handbook. This initial audit will be followed by an annual review, the purpose of which is to incorporate or amend any policies that may need to be changed as a result of new legislation or developments in case law. In the general run of events, we get plenty of notice about new pieces of legislation and your documentation is unlikely to need reviewing more than once a year.
If you have any queries about your responsibilities as an employer, then you can simply telephone or email us for advice in the first instance.

Representation

We can provide advice and representation for you should any employees or ex-employees bring a claim against you in the Employment Tribunal or the County Court. Although a very large number of potential claims can be prevented by following the correct procedures, it remains the case that employment legislation is often very complex. Even with the best intentions in the world, it is never possible for employers to wholly avoid potential claims.
Should you find yourselves facing a claim, we can advise you on the options, help prepare your case and provide representation at the Employment Tribunal. All of our solicitors in the employment team are expected to carry out their own advocacy, so wherever possible we will represent you ourselves rather than passing your case to a barrister.

Advice and Assistance for Employers

We believe that it is important that our solicitors deal with employment cases on both sides and our team has experience of acting for both employers and employees. We can provide advice and assistance to individual clients on all aspects of employment law including unfair dismissal, redundancy, equal pay, discrimination and breaches of contract. We also deal with a large number of compromise agreements.

When people are searching for Cumbria employment solicitors, Livingstons provide an efficient and swift service from their offices in Ulverston and Dalton. No matter where you live or work in Cumbria; if your case is particularly serious, we can also offer free home visits.

We strive to offer a competitively priced service and, depending on client requirements, can provide different levels of service, from general “background” advice to advice and assistance with preparing a claim through to a full service including representation at Employment Tribunals or in the County Court.
In some cases, we may be able to offer conditional fee arrangements, whereby we calculate our fees as a fixed share of any compensation or settlement that a client is awarded (meaning that if the client gets nothing, we will normally get nothing too).
At present, we also hold a contract with the Legal Services Commission to provide Legal Help (Legal Aid as was) in employment matters to those clients who qualify financially for assistance.
